Convention relating to the Status of Refugees

ဒုကၡသည္မ်ား၏ အခြင့္အေရးဆိုင္ရာ ကြန္ဗင္းရွင္း


A UN Convention adopted in 1951 which is the key legal document in defining who is a refugee, the rights of refugees, and the legal obligations of states. The 1967 Protocol removed geographical and temporal restrictions from the Convention. The Convention clearly spells out who is a refugee and the kind of legal protection, other assistance and social rights he or she should receive from the states that have signed up to it. The Convention also defines a refugee's obligations to host governments, and certain categories of people such as war criminals who do not qualify for refugee status. Initially the 1951 Convention was more or less limited to protecting European refugees in the aftermath of World War II, but the 1967 Protocol expanded its scope as the problem of displacement spread around the world. Together, they have also helped inspire important regional instruments such as the 1969 OAU Refugee Convention in Africa and the 1984 Latin American Cartagena Declaration.


၁၉၅၁ခုႏွစ္တြင္လက္ခံခဲ့ေသာ သေဘာတူညီမႈသည္ မည္သို႔ေသာသူသည္ ခိုလႈံသူဒုကၡသည္ၿဖစ္သည္ဆိုသည္ကိုလည္းေကာင္း၊ ခိုလႈံသူဒုကၡသည္၏ အခြင့္အေရးမ်ားႏွင့္ ဥပေဒအရ ႏိုင္ငံမ်ား၏တာ၀န္ကို အဓိပၸါယ္သတ္မွတ္ထားေသာ အဓိကက်သည့္ ဥပေဒတစ္ရပ္ၿဖစ္သည္။ ၁၉၇၆ သေဘာတူညီမူသည္ ကာလ၊ ေဒသဆိုင္ရာ အကန္႔အသတ္တို႔ကို ယင္းသေဘာတူညီမူမွ ဖယ္ရွားခဲ့သည္။ သေဘာတူညီမႈက မည္သူသည္ ခိုလႈံသူဒုကၡသည္ျဖစ္သည္ ဆိုေသာအခ်က္၊ ဥပေဒမွေပးေသာ အကာအကြယ္အမ်ိဳးအစား၊ အၿခားအေထာက္အပံ့မ်ားႏွင့္ လူမူေရးဆိုင္ရာအခြင့္အေရးတို႔ကို သူေရြးခ်ယ္ေသာႏုိင္ငံမွ ရရွိသင့္သည္ဟု ေဖာ္ၿပပါရွိသည္။
